The employment of staff is heavily regulated and so it’s essential to comply with Irish employment laws.  Employment law is in place to guarantee a fair and safe working environment for employers and employees. Statutes and strict rules outline, for the employer, how their employee’s should be treated within the workplace. Many employers and employees often don’t realise how many rules and regulations are covered by employment law, leading to confusion for employers and employees alike.  Even before recruiting new employees, employers should refer to employment law to ensure they are up to date with all aspect, while at the same time its important that employees have a sound understanding of employment law.

For a mutually beneficial employment relationship, it is vitally important that employment rights and responsibilities are clarified to protect the employer and the employee. 

The reasons included are:

  • Employment contracts can help resolve any legal disputes that may arise between you and your employee.
  • Provides clarity for staff on duties and responbilities.
  • Helps manage budgets and ensure staff receive appropriate pay.

The aim of the Diploma in Employment Law is to provide the learner with an overview of the laws and regulations that affect the functioning of the employment relationship. The programme examines the duties of both employees and employers and attempts to provide learners with a broad understanding of employment law issues through the analysis of existing legislation and case law.

The aims and objectives of this programme:
  • To provide learners with an understanding of the legal nature of the employment relationship
  • To provide learners with an understanding of the rights of employees in the workplace
  • To provide learners with an understanding of the responsibilities of employers in the workplace
  • To provide learners with an understanding of the litigation and resolution of employment disputes and the remedies available to both employers and employees when such disputes arise.

Course Overview

Learners will be introduced to principles of employment law through the lecture programme. Learners will then be expected to participate in class discussions relating to the application of principles to factual scenarios relevant to employment. A key part of learning in this class comes from applying the concepts through discussion and active participation in the class. Therefore, learners will be expected to prepare, to be present and to participate at all class sessions. Tutorial sessions will provide learners with specific feedback on their individual attempts to apply the law to factual problem scenarios. Seminars will involve group discussions of problem questions to assist learners in applying the law to individual sets of facts and to encourage exploration of the issues through group discussion. Current issues in the news relating to the lecture topics will be highlighted and discussed in the classroom with reference to relevant articles.

On successful completion of this programme, learners will be able to:

  1. Outline the key components and principles of employment law and its sources.
  2. Identify and define the legal obligations that arise for employers and the corresponding rights of employees in a workplace setting.
  3. Identify and explain the processes and procedures associated with the various courts, tribunals and other bodies that adjudicate on employment disputes.
  4. Work independently to a fixed deadline, assuming responsibility for the quality of work produced, demonstrating self-awareness in their work.
  5. Apply problem-solving skills to theoretical and real-life employment law questions.

What is a Professional Diploma?

An IBAT Professional Diploma is a focused, short duration practical course that consolidates, upskills and/or reskills learners in a professional area. They are stand-alone qualifications  that do not lead to an award on the National Framework of Qualifications (NFQ).

The Diploma in Employment Law aims to provide learners with a grounding in the areas of Irish Employment Law most relevant today, with an emphasis on the practical implications of employment legislation, and will over the follow areas:

Employment Law Introduction

Week 2
Sources of Law, the Constitution, statute and common law

Week 3
The Nature of the employment relationship

Week 4
Differentiating between other relationships: the employee / contractor distinction

Week 5
Unfair dismissal, constructive dismissal and wrongful dismissal

Week 6
Unfair dismissal, constructive dismissal and wrongful dismissal (continued)

Week 7
Payment of wages and working time complaints

Week 8
Health and safety in the workplace and penalisation

Week 9
The resolution of workplace relations disputes and making a complaint

Week 10
Procedural aspects of workplace disputes: the WRC and Labour Court

Week 11
Recap and conclusion

The assessment will involves a legal factual problem case on the area of employment law. The scenario given presents the learner with content they need to interpret and understand before attempting to apply legal principles and relevant case law; then a final written examination containing a mixture of theory questions and practical problem-based questions.
