The employment of staff is heavily regulated so it’s essential to comply with Irish employment laws. Employment law is in place to guarantee a fair and safe working environment for employers and employees and this is a great course to get you started on a career in this field.
This course will:
- Provide learners with an understanding of the legal nature of the employment relationship.
- Provide learners with an understanding of the rights of employees in the workplace.
- Provide learners with an understanding of the responsibilities of employers in the workplace.
- Provide learners with an understanding of the litigation and resolution of employment disputes and the remedies available to both employers and employees when such disputes arise.
Course Details
The Diploma in Employment Law aims to provide learners with a grounding in the areas of Irish Employment Law most relevant today, with an emphasis on the practical implications of employment legislation, and will over the follow areas:
- Sources of Law, the Constitution, statute and common law
- The Nature of the employment relationship
- Differentiating between other relationships: the employee / contractor distinction
- Unfair dismissal, constructive dismissal and wrongful dismissal
- Payment of wages and working time complaints
- Health and safety in the workplace and penalisation
- The resolution of workplace relations disputes and making a complaint
- Procedural aspects of workplace disputes: the WRC and Labour Court
Assessment
The assessment involves a legal factual problem case on the area of employment law. The scenario given presents the learner with content they need to interpret and understand before attempting to apply legal principles and relevant case law. There is a final written examination containing a mixture of theory questions and practical problem-based questions.
What is a Professional Diploma?
An IBAT Professional Diploma is a focused, short duration practical course that consolidates, upskills and/or reskills learners in a professional area. They are stand-alone qualifications that do not lead to an award on the National Framework of Qualifications (NFQ).
